Legal Services:We will utilize all our internal resources and make every effort to recover the balance placed for collection however on occasion, when appropriate, we seek the assistance of our own attorneys. Being ourselves a law firm, we can apply very low attorney rates, on behalf of our clients, on individual cases based on the age and balance of the account. If it is necessary to involve one of our collection attorneys, the contingency collection fee is 25% for commercial accounts and 28% for consumer accounts. • If a lawsuit is necessary, the contingency collection fee is 28% for commercial accounts and 35% for consumer accounts and our client pays court costs as determined by the individual court. However, no lawsuit will commence, nor will costs be incurred without prior client approval. requirements. Merchandise Returns: Commissions are charged on authorized returns based on one-half the normal fee. Discovery Fee: If our collection efforts reveal that an account was paid prior to placement, one-half the normal fee will apply. Compensation Fees: Compensation may be retained for costs and expenses on all lawful collections over the principal amount. Withdrawal Fees: Accounts withdrawn after assignment, and in the process of collection are subject to regular fees or handling fees. Non Standard Rates: We reserve the right to negotiate fees prior to accepting placement based on significantly aged accounts and/or large portfolios. Accounting and Remitting There is actually no restriction on the amount of money that can be remitted either to, or from Iran. If check or bank draft, we will forward directly to the client. Payment of commission will be paid by the client in 15 to 30 days. If payment is made in favor of our law firm, the amount is deposited in a bank account, commission is deducted and the net balance is forwarded - to the client by check. Should any debt not be collected ex-curia, the client is informed accordingly with the reasons and the account is closed unless the client wishes to go to litigation stage in which case a down payment will be required.. . Courts & Legal Proceedings Appropriate documentation is required to file legal actions such as power of attorney (to be legalized by an Iranian consular officer if given outside Iran), original debt documents etc. After the revolution, Iran Council of Guardians ruled that that there should be no Statute for Limitations for civil claims i.e. a creditor may always sue his debtor for recovery. There are three levels of courts in Iran for collection of moneys owed : [] Dispute Settlement Boards which are the equivalents of Summary or Small Claims Courts which are to adjudicate claims below IR Rls 10,000,000 or the equivalent of US$ 1100 in local currency [] Courts of First Instance [] Courts of Appeal If a debtor fails to appear in court a default judgment can be obtained. Service of process is only available through the court unless the judgment has been rendered by a foreign forum in a foreign jurisdiction in which case service can be ensured by a local law firm against a certificate of service . The process for levying execution starts with opening a file with the execution department at the competent judicial complex (where the hearing court premises lie) which will enable the creditor to freeze all bank accounts and assets available by the debtor.
